1. Company

Keus is an individual company with limited liability (EIRL) with a social capital of 6200 euros registered under the sole number 528 714 371 000 51, whose head office is located at 5, impasse Théodore 29120 Pont-l’Abbé FRANCE (hereinafter “Keus”) : contact@keus-store.com.
The site keus-store.com allows the Customer to order online bags of different brands (hereinafter “the (or) Product (s)”) according to these terms and conditions.

2. Overview

Those general conditions of sale are intended to define the rights and obligations of Keus and the Customer for the products presented by Keus on its website www.keus-store.com (hereinafter “the Site”). They apply exclusively between Keus and any consumer, natural person visiting or making a purchase via said Site. Any order placed with Keus on the www.keus-store.com website therefore implies the unconditional acceptance by the Customer of these conditions. These general conditions of sale are permanently accessible at the following address : https://www.keus-store.com/en/terms-conditions in a computer format allowing their printing, so that what the Customer may proceed with their reproduction or backup.

3. Modification of terms and conditions

Keus can modify these General Terms and Conditions of Sale at any time and without notice by Keus, the applicable conditions being those in effect at the date of the order by the Customer.

4. Others modifications

4.1 – Modifications of the Site
Keus may add, modify or delete any part of the Site, including, without limitation, any content (as defined below) at any time without notice.

4.2 – Personal information / privacy
Customers are committed to providing accurate, complete and up-to-date information. This information is required for the purchase of products and memberships. Keus can block sales to customers who provide false, inaccurate or incomplete data. The Customer acknowledges that Keus uses a third-party payment processing service to process orders and debits on their credit card. The Keus Privacy Policy is described below in “Personal Data” and explains how personally identifiable customer information is collected, used and disclosed. Customer acknowledges that Keus may use its personal information in accordance with the terms of the Privacy Policy.

5. Products and compliance

5.1 – The products offered for sale are presented on the Keus website and accompanied by a description.

5.2 – The Products offered by Keus comply with the applicable standards in France and the European Union. The elements such as photographs, texts, graphics as well as all information and features illustrating and / or accompanying the Products are not contractual, which the Customer acknowledges.

5.3 – Accordingly, Keus shall not incur any liability for any error or omission of any of these elements or in the event of modification of said elements by the suppliers and / or editors.

6. Customer’s obligations

6.1 – The Customer declares to be at least eighteen (18) years old and to have the legal capacity or to hold a parental authorization allowing him to place an order on the Site.

6.2 – The Customer undertakes to communicate to Keus the real and necessary information needed to perform the service that is the subject of these conditions as requested online and according to his situation, including his surname, first name, address, telephone and valid e-mail.

6.3 – The Customer is responsible for the consequences arising from information transmitted false or inaccurate or whose recovery is illegal.

7. Order

7.1 – The Customer guarantees that he is fully entitled to use the payment card for the payment of his order and that these means of payment give access to sufficient funds to cover all the costs resulting from the use of the services of keus-store.com.

7.2 – Any order will be validated only after acceptance of the payment.

7.3 – Failure by a person to meet the obligations under these General Terms and Conditions of Sale, and in particular any incident of payment of the price of an order, may result in the suspension of access to the service of keus-store.com, even the termination of his account depending on the degree of seriousness of the acts in question, without prejudice to any damages that could be solicited by Keus. As a result, keus-store.com reserves the right to refuse any order from a person with whom such a dispute exists.

7.4 – Keus can accept orders within the limits of available stocks. He informs the Customer of the availability of Products sold on the Site at the time of confirmation of the order.

7.5 – Once the order has been placed, Keus sends the Customer an e-mail confirming it. He informs him of the sending of the Products.

7.6 – If, despite the vigilance of Keus, the Products are unavailable, Keus will inform the Customer by e-mail as soon as possible. In case of unavailability of the product or service, the Customer then has the option : – Either to be delivered a product or service of quality and equivalent price, within the limits of available stocks; – To be refunded the price of the product or service ordered within 30 days of his request. The Customer may then cancel the order and be reimbursed, if necessary, the sums already paid. The definitive or temporary unavailability can not in any way engage the responsibility of Keus, any more than it can not open any right to compensation or damages in favor of the Customer.

8. Price

8.1 – The prices displayed on the Site are indicated in euros all taxes included (French VAT and other possibly applicable taxes), excluding shipping costs, contribution to order processing fees and packaging costs.

8.2 – Shipping costs, participation in order processing fees and packaging costs will be indicated in the Customer’s basket, before final confirmation of the order.

8.3 – Prices can be modified at any time, without notice and especially in case of change of tax or economic data. Items will be billed based on the rates in effect at the time of registration of the order.

9. Delivery

9.1 – Keus delivers its products all over the world.

9.2 – The products are shipped with the delivery note, to the delivery address indicated by the Customer when ordering. Delivery can not be made to hotels or postboxes.

9.3 – Delivery times indicated on the site are indicative times, corresponding to the average time of processing and delivery. In order to meet these deadlines, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access code , names and / or intercom numbers, etc.).

9.4 – Items are delivered within 1 to 15 working days from the order throughout Europe. This time is given as an indication and may vary depending on the availability of items. Exceeding this period may in no case be held against Keus, nor give rise to a termination of the contract or any compensation for damages. Beyond a period of one month from the date of the order, Keus will proceed to the refund by check or bank transfer of the undelivered goods.

9.5 – Keus undertakes to inform the Customer of the progress of the processing of his order. Without prejudice to the time available to the Customer under the right of withdrawal defined in Article 11 below, it is the Customer’s responsibility to check the shipments on arrival and make any reservations and claims that appear justified, or even refuse the package if it is likely to have been opened or if it shows obvious signs of deterioration. These reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days of delivery of the products, a copy will be sent immediately to Keus.

9.6 – The packages are delivered by La Poste, Colissimo, Bpost, DHL or by express carrier to the address indicated during the order. As such, Keus can not guarantee a precise time of delivery. The transfer of risk takes place at the moment of delivery of the goods.

9.7 – Keus can not be held responsible in case of contractual non-performance resulting from a case of force majeure including, and without limitation, in case of war, riot, insurrection, interruption of transport, problem import, strike, scarcity, fire, earthquake, storm, flood.

10. Payment

10.1 – The full payment must be made when ordering. At no time the sums paid can not be considered as a deposit or installments. The Customer pays his order by credit card (Visa, Eurocard / Mastercard) in accordance with the provisions of this article.

10.2 – For any transaction, the Customer will indicate the number on the front of his card, the expiry date of his card and the cryptogram on the back of his card (last three digits).

10.3 – The communication by the Customer of his credit card number is the authorization for Keus to debit his account for the amount of his order.

10.4 – No sending against refund will be accepted, whatever the reason.

10.5 – Keus retains ownership of the item until full payment by the Customer. Purchases are made securely. For payments by credit card (credit card, blue card visa and e-credit card), Stripe is responsible for securing payments. All information that Customers communicate to Keus is strictly protected and ensures the conformity and security of each transaction.

11. Retract right

11.1 – With regard to the goods marketed on the keus-store.com Website, Customers have the right to withdraw and return their product(s) and / or service(s) for thirty (30) days from the date of sale.

11.2 – The Customer may, within thirty days after the delivery of his order, and concerning products subject to the right of withdrawal, return his Product to Keus.

11.3 – Prior to any return of a product, the Customer must indicate his intention by sending an email to the following address : contact@keus-store.com.

11.4 – The refund of the Customer will be made by any means of payment within thirty days from receipt by Keus of the request for exercise of the right of withdrawal by the Customer, provided that the product or service has been returned to Keus, in a perfectly new state.
Products returned damaged, incomplete, soiled or without the original packaging will not be returned, exchanged or refunded.
Beyond the period of 30 days from receipt, the goods will not be returned, exchanged or refunded.
During the sales period, the products are neither exchanged nor refunded.

11.5 – The return of all products or services ordered will result in a refund equal to the total amount paid by the Customer, ie the purchase price of the product(s) or service(s) purchased excluding any delivery charges. The return of a command is indicated as a negative operation.

11.6 – The return or exchange is at the Customer’s responsability.
